Welcome to EventHeave Limited ("EventHeave", "we," "our," or "us"). These Terms and Conditions govern your access to and use of our website, www.EventHeave.com (the "Platform"), and any services offered through it. By using the Platform, you agree to these Terms. If you do not agree, please do not use our services.

EventHeave Limited is an online event ticketing platform that enables third-party event organisers ("organisers") to create, promote, and sell tickets for their events. EventHeave acts as an intermediary between organisers and Customers ("Buyers"), facilitating ticket sales, payment processing, and ticket delivery.

By accessing or using EventHeave, you agree to:

• Provide accurate and complete information during registration or checkout.
• Use the Platform only for lawful purposes.
• Not use the Platform to promote, facilitate, or engage in any illegal, immoral, or harmful activities, including but not limited to pornography, human trafficking, fraud, or the sale of prohibited goods or services.
• Not misuse, hack, or interfere with the functionality, security, or integrity of the Platform.

EventHeave reserves the right to suspend, restrict, or terminate access to any user or organiser found to be in breach of this clause or any applicable laws.

All tickets sold through EventHeave are subject to availability and the organiser"s terms.

• Tickets are delivered electronically (e-tickets or QR codes) to the email address provided at purchase.
• Buyers are responsible for safeguarding their tickets. EventHeave is not liable for lost, stolen, or duplicated tickets.

Ticket prices are set by the organiser and may include EventHeave"s service and payment processing fees.

Payments for tickets are processed securely through third-party payment service providers integrated into the EventHeave platform. EventHeave does not collect or store payment information directly. Upon successful payment, the third-party processor deducts applicable service and processing charges, after which the balance is remitted to the organiser in accordance with the applicable settlement terms.

Refunds may be facilitated under the following conditions:

• The event is canceled or rescheduled by the organiser.
• The event is affected by circumstances beyond reasonable control, including but not limited to:
  • Severe or extraordinary weather (such as flood, earthquake, or other acts of God);
  • Fire, war, pandemic, epidemic, insurrection, terrorist act, riot, accident, or emergency;
  • Government action, restriction, or directive that makes the event impossible to hold.

If any of the above occurs:

• EventHeave will assist Buyers in facilitating a refund from the Event organiser.
• Refunds are subject to the organiser"s refund policy and applicable deductions.
• Payments are processed through third-party payment service providers, and refunds may take 3 to 15 working days to be completed.
• EventHeave shall not be held liable for any delay, denial, or amount of refund, as final responsibility for refunds rests solely with the organiser.
• Service charges and processing fees are non-refundable.
• Organisers are responsible for notifying buyers of any cancellations or schedule changes.

EventHeave is not the organiser of events listed on its platform. All responsibilities regarding event quality, safety, admission, performance, and compliance with applicable laws rest solely with the organiser.

EventHeave is not liable for:

• Event cancellations, rescheduling, or changes in program.
• Any injury, loss, or damage incurred at or in connection with an event.

EventHeave may, upon special request, assist event organisers in listing and publishing their events on the Platform.

• EventHeave also reserves the right to list verifiable or credible events obtained from reliable public sources or directly from the organisers.
• All event details will be updated and maintained in accordance with verified information received from the source or the event organiser.
• EventHeave does not guarantee the accuracy of event information provided by third parties but will make reasonable efforts to ensure that only legitimate and verifiable events are displayed on the Platform.

Users agree not to:

• Use EventHeave for fraudulent, misleading, or illegal activities, including but not limited to pornography, human trafficking, money laundering, or the promotion of unlawful content or services.
• Reproduce, resell, or exploit any part of the Platform without prior written permission.
• Upload, post, or transmit any harmful code, malware, obscene material, or unauthorized content.

EventHeave reserves the right to report and take appropriate legal action against any user or organiser involved in activities that violate this clause or applicable laws.

All trademarks, content, software, and materials on the Platform are the intellectual property of EventHeave Limited or its licensors. You may not copy, modify, distribute, or use any material without prior written consent.

To the fullest extent permitted by law:

• EventHeave shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform or attendance at any event.
• EventHeave"s total liability, if any, shall not exceed the total service fee paid for the affected transaction.

You agree to indemnify and hold harmless EventHeave Limited, its officers, employees, and affiliates from any claims, losses, or damages arising out of your use of the Platform or violation of these Terms.

EventHeave may update these Terms and Conditions or its Privacy Policy from time to time to reflect changes in our operations, applicable laws, or for other legitimate reasons.

• Any updates will be posted on this page with a revised "Last Updated" date.
• In the case of material changes, EventHeave will provide additional notice — such as a push notification on the Platform or an email alert to registered users.
• Continued use of the Platform after such updates constitutes your acknowledgment and acceptance of the revised Terms or Policy.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising under or in connection with these Terms shall be resolved amicably, failing which it shall be submitted to the courts of competent jurisdiction in Lagos, Nigeria.

EventHeave Limited respects your privacy and is committed to protecting your personal data in compliance with the Nigeria Data Protection Act (NDPA) 2023 and other applicable data protection laws. By using our Platform, you consent to the collection and use of your personal information as described in this section and in our Privacy Policy.

1. Information We Collect: We may collect personal information such as your name, email address, phone number, and payment details when you:
   • Register or create an account on our Platform;
   • Purchase or reserve tickets;
   • Contact our support team; or
   • Interact with our website and social media channels.
2. How We Use Your Information: Your personal information may be used to:
   • Process your ticket orders and deliver e-tickets;
   • Communicate important updates or changes regarding events;
   • Improve our services, user experience, and customer support;
   • Prevent fraudulent or unlawful activity; and
   • Comply with legal and regulatory obligations.
3. Data Sharing:
   • EventHeave may share necessary information with Event organisers, payment processors, and service providers solely to enable ticket sales, payments, and event access.
   • We do not sell, rent, or trade users" personal data to third parties for marketing purposes.
4. Data Security: We implement reasonable administrative, technical, and physical safeguards to protect your personal data from unauthorized access, disclosure, alteration, or destruction.
5. User Rights: Under the Nigeria Data Protection Act, you have the right to:
   • Access and obtain a copy of your personal data;
   • Request correction or deletion of inaccurate information;
   • Withdraw consent for data processing (where applicable); and
   • Lodge a complaint with the Nigeria Data Protection Commission (NDPC) if you believe your rights have been violated.
6. Data Retention: We retain personal data only as long as necessary to fulfill the purposes outlined above or as required by law.
7. Cookies and Tracking: Our Platform may use cookies or similar technologies to enhance your user experience and analyze traffic. You may choose to disable cookies in your browser settings, but some features may not function properly.

Please note that even after opting out of marketing communications, you may still receive important transactional or service-related messages (such as payment confirmations, ticket updates, or security notices).

If you no longer wish to receive communications from third-party event organisers or partners, you will need to contact those third parties directly.

EventHeave will retain and use your personal data only for as long as necessary to provide our services, fulfill contractual obligations, and comply with applicable legal, regulatory, or tax requirements.

• Generally, personal data may be retained for up to 10 years after the expiration or termination of your account or contract with EventHeave, unless a longer period is required by law.
• At your request, EventHeave may delete or anonymize your personal data held in our systems, unless retention is legally required to comply with statutory, tax, or regulatory obligations.
